Brand use during free access
If you use Event Stock Tracker on a free basis (including trials or complimentary access), you grant the app owner permission to publicly reference your venue or hotel name and logo for marketing and case-study purposes. Operational data, stock levels, staff names, and event information remain private and are never published.
1. Scope & Definitions
These Terms & Conditions ("Terms") govern access to and use of the Event Stock Tracker ("EST", "we", "us") web and mobile experiences, including companion APIs, downloadable content, and onboarding services. "User" or "you" refers to any hotel owner, staff member, or authorised contractor interacting with the platform. By signing up or continuing to use EST you agree to these Terms, the Privacy Policy, the Refund & Cancellation Policy, and any additional order forms executed with us.
2. Eligibility & Accounts
You must be at least 18 years old, capable of forming a binding contract, and authorised by the hotel or hospitality group you represent. The account owner is responsible for all activity under their workspace, including staff approvals, permission levels, and device security. 3. Subscriptions, Billing & Owner Codes
Paid plans renew automatically for the selected monthly or yearly term unless cancelled before the renewal date. Owner Codes are delivered only after Stripe confirms payment and may expire if not redeemed within the stated window. Prices exclude applicable taxes unless indicated otherwise. Late or failed payments may lead to suspension, restricted features, or deletion of pending Owner Codes. Please review the Refund & Cancellation Policy for detailed billing rights.
4. Acceptable Use & Data Ownership
You will not misuse EST, attempt to gain unauthorised access, or upload harmful code. Content you submit (drinks, events, WOW adjustments, staff notes, logos) remains yours, but you grant EST a limited licence to host and process that information solely to deliver the service. You represent that you have obtained all rights and consents needed to share the information you enter, including employee data and supplier pricing.
5. Confidentiality & Privacy
We treat hotel configuration, event performance, and stock levels as confidential information and only disclose them in accordance with the Privacy Policy, applicable law, or your instructions. Where we engage service providers (cloud hosting, analytics, email, payments) they are bound by confidentiality agreements and data-processing terms consistent with the Australian Privacy Act 1988 and the Australian Privacy Principles.
6. Platform Availability & Third-Party Services
EST aims for high availability but may occasionally schedule maintenance or experience outages. We are not responsible for delays caused by your internet provider, device configuration, third-party hardware, or external integrations. Links to external services are provided for convenience and do not imply endorsement or liability for those offerings.
7. Disclaimers & Limitation of Liability
EST is provided on an "as is" basis without warranties of merchantability, fitness for a particular purpose, or non-infringement. To the extent permitted by law, our aggregate liability for claims arising out of the service is limited to the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for consequential, indirect, or lost-profit damages. Nothing in these Terms limits liability that cannot legally be excluded.
8. Indemnity
You will indemnify and hold EST harmless from claims, damages, and expenses arising from (a) data or content you submit, (b) violations of these Terms, or (c) misuse of the platform by your staff or contractors. We will provide prompt notice of any claim and allow you to participate in the defence, at your cost.
9. Suspension & Termination
We may suspend or terminate access for breach of these Terms, failure to pay, suspected fraud, or behaviour that risks the security of the platform. Upon termination you must cease use, pay outstanding amounts, and download any reports you require before access is revoked. Sections regarding ownership, payment, confidentiality, and liability survive termination.
10. Governing Law & Changes
These Terms are governed by the laws of Western Australia, Australia, without regard to conflict-of-law principles. We may update this document periodically; changes take effect when posted with an updated "Updated" date. Continued use after the effective date constitutes acceptance.
